OwnerRoute Terms of Service
The agreement for using OwnerRoute.

These Terms of Service (“Terms”) are a binding agreement between you and OwnerRoute governing your access to and use of www.ownerroute.com and our related services (together, the “Services”). Please read them carefully. By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.
Please read Section 17 (Dispute Resolution & Arbitration) carefully. It requires most disputes to be resolved by binding individual arbitration and waives your right to participate in a class action, unless you opt out within 30 days as described there. These Terms are provided by OwnerRoute and are not legal advice.
Acceptance and eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a business or another person, you represent that you are authorized to bind them to these Terms. If you do not agree to these Terms, do not use the Services.
What OwnerRoute is — and is not
OwnerRoute is a technology platform that helps homeowners prepare, present, and market their own homes, helps buyers discover owner-listed homes, and connects users with licensed professionals when they choose. OwnerRoute is not a real estate brokerage, agent, attorney, appraiser, inspector, lender, title company, escrow agent, or multiple listing service, and does not provide legal, tax, financial, or brokerage advice.
OwnerRoute is not a party to any transaction between users, does not represent any party, and does not guarantee any sale, buyer, offer, price, property condition, or outcome. Licensed services, when provided, are delivered by independent licensed partners under their own agreements.
Your account
You must provide an email address you control, keep your credentials secure, and provide accurate information. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts as described in these Terms.
Your content and listings
You retain ownership of the property information, photos, descriptions, and other content you submit (“Your Content”). You represent that you have the authority and all rights necessary to submit and, where applicable, publish Your Content, and that it is accurate and kept current — including facts, price, disclosures, availability, and status.
You grant OwnerRoute a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, resize, adapt, display, and distribute Your Content as needed to operate and provide the Services you select (including publishing a listing and, if you choose, distributing it to a multiple listing service through a licensed partner). This license ends when you remove Your Content, except for content already distributed to third parties, retained in backups, or required to be kept by law.
Acceptable use
You agree not to:
- Violate any law, regulation, or third-party right.
- Publish discriminatory preferences, limitations, or statements, or otherwise violate fair-housing or anti-discrimination laws.
- Post false, misleading, fraudulent, or deceptive information, or impersonate anyone.
- Upload content you do not own or have permission to use, or that infringes intellectual property.
- Upload malware, or scrape, harvest, or access the Services by automated means without permission.
- Attempt to breach security, interfere with the Services, or access accounts or data that are not yours.
- Share sensitive personal or financial information, passwords, or entry codes through the Services.
Fair housing and legal compliance
You are solely responsible for complying with all laws that apply to your sale, purchase, or listing, including the federal Fair Housing Act, state and local fair-housing and consumer-protection laws, advertising rules, and seller-disclosure obligations. Our educational materials, including our paperwork guide, are informational only and are not a substitute for a licensed professional.
MLS access and licensed partners
Flat-fee multiple listing service (MLS) entry and other licensed services are provided by independent licensed broker partners, not by OwnerRoute, and are subject to those partners’ separate agreements, fees, and requirements. Any buyer-broker compensation is negotiated privately, is not set by law, is fully negotiable, and is not posted on the MLS. You are responsible for your own transaction and for engaging your own title company, closing attorney, or other professionals.
Cash offers and third-party buyers
If you request a cash offer, OwnerRoute may facilitate an introduction to one or more independent third-party buyers. OwnerRoute does not make offers, is not a party to any resulting transaction, and does not guarantee that an offer will be made or that any particular price or terms will be offered. Any offer is non-binding until you and the buyer sign a written agreement. Evaluate all offers independently and seek professional advice.
Agent and broker partnerships
Real estate agents and brokers who apply to partner with us do so subject to a separate written partnership agreement and applicable licensing requirements. Submitting an inquiry does not create a partnership, guarantee any leads or territory, or obligate either party. Partners are independent contractors, not employees or agents of OwnerRoute.
Fees
Some features are free and others are paid. Any fees, and the products they apply to, are described at the point of purchase. Paid third-party or partner services are billed under their own terms. You are responsible for applicable taxes. Unless required by law or stated otherwise, fees are non-refundable.
No professional advice
Content on the Services is provided for general informational purposes and is not legal, tax, financial, appraisal, inspection, or real-estate advice. Real estate transactions are complex and vary by state and county. Consult a qualified attorney, title company, or other professional before making decisions.
Moderation and availability
We may review, reject, limit, pause, or remove any account, listing, photo, or message that we reasonably believe is unlawful, unsafe, deceptive, fraudulent, infringing, technically harmful, or inconsistent with these Terms. We may modify, suspend, or discontinue any part of the Services at any time, and availability may change while we maintain and improve the platform.
Intellectual property
The Services, including their design, text, graphics, software, and the OwnerRoute name and logos, are owned by OwnerRoute or its licensors and are protected by law. We grant you a limited, revocable, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works from the Services except as expressly permitted.
Third-party services
The Services rely on and link to third-party services (such as mapping providers, analytics, and, when you engage them, broker or title partners). We are not responsible for third-party services, and your use of them is governed by their terms and policies.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. OwnerRoute DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION, LISTING, OFFER, VALUATION, MAP, OR THIRD-PARTY CONTENT IS ACCURATE, COMPLETE, OR RELIABLE. YOU USE THE SERVICES AT YOUR OWN RISK.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OwnerRoute AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR ANY TRANSACTION BETWEEN USERS, EVEN IF ADVISED OF THE POSSIBILITY. OwnerRoute’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID OwnerRoute IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
Indemnification
You agree to defend, indemnify, and hold harmless OwnerRoute and its affiliates, officers, employees, and partners from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Services, your transactions or communications with other users, or your violation of these Terms or any law or third-party right.
Dispute resolution & arbitration
Informal resolution first. Before starting a formal proceeding, you and OwnerRoute agree to try to resolve any dispute informally by contacting [email protected] and allowing 30 days to resolve it.
Binding arbitration. If we cannot resolve a dispute informally, you and OwnerRoute agree that any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by a recognized arbitration provider under its consumer rules, rather than in court, except that either party may bring an individual claim in small-claims court.
Class-action waiver. Disputes will be arbitrated only on an individual basis. You and OwnerRoute waive any right to participate in a class, collective, or representative action.
30-day opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect the other provisions of these Terms.
Governing law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Clark County, Indiana, and you consent to their jurisdiction, unless applicable law requires otherwise.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date and provide additional notice where appropriate. Your continued use of the Services after an update means you accept the revised Terms.
General
These Terms and our Privacy Policy are the entire agreement between you and OwnerRoute regarding the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. You consent to receive notices and communications electronically.
